How we care for what your family shares

EverKeep Stories ("EverKeep," "we," "us," or "our") preserves family stories. Families invite us into their homes, their memories, and their history. This policy explains what information we collect, why we collect it, how we protect it, and the choices you have, including your choices about the emails and text messages we send.

It applies to:

  • our website at everkeepstories.com and the landing pages we run for our advertising and events (together, the "Site");
  • our documentary production and legacy services, including discovery calls, interviews, filming, and the digitizing of family photographs, home movies, letters, and recordings (the "Services"); and
  • the EverKeep Family Vault, our private, invitation-only web application where a family's films live and where family members share memories (the "Vault").

Together, we call these the "EverKeep Experience."

01Who we are

EverKeep Stories is operated by EverKeep Stories LLC, located in New Oxford, Pennsylvania, United States. We are the party responsible for the personal information described in this policy.

02Information we collect

Information you give us

When you contact us, request information, or schedule a discovery call. Your name, email address, phone number, and anything you write in your message. Our landing pages may also ask about your family and what you hope to preserve, such as who you would like to interview, an upcoming milestone, or how you heard about us. If you book a consultation, we keep notes from that conversation so we can prepare a plan for your family.

When you opt in to text messages. Your mobile number, your consent, the date and time you gave it, and the page or method you used to give it. Section 4 explains our text messaging program in full.

When you subscribe to updates. Your name and email address, and which topics you asked to hear about.

When you engage our Services. Details about your family and the people who will take part: names, relationships, contact information, dates and places that matter to your story, and the stories themselves. To create your film, we also collect:

  • audio and video recordings of interviews and family gatherings;
  • photographs, home movies, letters, documents, and other keepsakes you choose to share with us, along with the information they contain;
  • release and consent forms signed by the people who appear in your film; and
  • billing and payment details. Card and bank information is handled by our payment processor; we do not store full card numbers.

When you place an order. If you purchase additional drives, Keepsake Boxes, or other Legacy Collection items, we collect your name, shipping address, email, phone number, and payment details, which our payment processor handles as described above.

When you use the Vault. To create and operate your account we collect:

  • your name, email address, and password (we store passwords only in hashed form and cannot read them);
  • an optional profile image and an optional family relationship (for example, "Grandson");
  • the names and email addresses of the people a Vault Owner invites as Key Holders;
  • the photographs, home movies, and other keepsakes we digitized for your family during production, which EverKeep places in your Vault;
  • everything you contribute inside the Vault: memory posts, photographs, short videos, comments, reactions, responses to memory prompts, and calendar events with their titles, dates, descriptions, locations, and images; and
  • your notification preferences.

When you share a review or testimonial. Your words, your name as you want it shown, and any photograph you provide, used only as described in Section 3.

When you take part in a survey, referral program, giveaway, or event. Whatever the survey or entry form asks for, such as your contact details and your answers, and, for a referral, the name and contact details of the person you refer. Participation is always voluntary. If you give us someone else's contact details, you confirm they are happy for us to reach out.

Information we collect automatically

On the Site. Like most websites, ours records technical information when you visit: your IP address, browser and device type, the pages you view, how long you stay, the site or advertisement that referred you, and approximate location derived from your IP address. Our website is hosted on Squarespace, which sets cookies needed for the site to function and for basic visitor analytics. We also use analytics and advertising tools described in Section 6, which set their own cookies and similar technologies.

When you receive our emails and texts. Our email service records whether an email was delivered, opened, and which links were clicked. Our messaging service records whether a text was delivered and any reply you send, including STOP and HELP.

In the Vault. We record sign-in activity, the device and browser you use, your IP address, and how you use the Vault, including which film you watched and where you left off so playback can resume. We keep basic logs of significant administrative actions (for example, when a Key Holder is removed) so we can support your family and keep the Vault secure. If something goes wrong technically, our error-monitoring service captures details of the error, which may include your account identifier.

Information we receive from others

From your family. A Vault Owner gives us the names and email addresses of the people they invite. Family members may share photographs, recordings, and stories that include you. When you engage our Services and give us permission, we may reach out to your loved ones to invite them to contribute memories or materials to your film.

From advertising and social platforms. When you click one of our advertisements or interact with our pages on Facebook, Instagram, or TikTok, those platforms tell us which campaign brought you to us. They do not give us your account information unless you send it to us yourself.

From people who refer you. If a friend, family member, or partner organization suggests we contact you, we record who referred you so we can thank them and so we can honor your wishes if you would rather not hear from us.

From our service providers. Our payment processor tells us whether a payment succeeded. Our email and messaging services tell us whether messages were delivered.

Children

Family films and Vault content often include children, and that is part of what makes them meaningful. A parent or legal guardian decides whether a child appears in a film or in Vault content. Vault accounts, however, are for adults: you must be at least 18 years old to create an account, to opt in to text messages, or to submit a form on the Site. We do not knowingly collect personal information directly from children under 13. If you believe a child has provided information to us, contact us and we will remove it.

03How we use information

We use the information we collect to:

  • respond to your inquiry and schedule consultations, by email, phone, or text message, according to the permissions you gave us;
  • send you the information you requested, such as pricing guides, event details, and examples of our work;
  • send you marketing emails and, if you opted in, marketing text messages about our services, events, seasonal offers, and stories from families we have worked with. You can stop these at any time (Sections 4, 5, and 11);
  • follow up after a consultation or quote;
  • plan, film, edit, and deliver your family's documentary and Legacy Collection, including the physical drives and Keepsake Box, and fulfill any additional orders;
  • arrange a private family premiere if your family chooses one;
  • create and operate your Vault, including hosting your films, storing your family's memories, delivering memory prompts, sending invitations, and showing content to the members of your Vault;
  • send the emails the Vault needs to work: invitations, email verification, password resets, memory prompts, comment notifications, and calendar reminders. You can adjust optional notifications in your settings;
  • process payments and keep our financial records;
  • show our advertisements to people who have visited the Site, and measure whether our advertising is working (Section 6);
  • publish your review or testimonial on the Site, in our advertising, and on our social media pages, only with your permission and only in the form you approved;
  • keep the EverKeep Experience secure, prevent unauthorized access, and enforce our Terms of Use;
  • understand how the Site and Vault are used so we can improve them;
  • comply with law and protect our rights and yours; and
  • with your separate written permission, share excerpts of your film or story publicly. We never use a family's film, photographs, or Vault content for marketing without that written permission.

We do not sell personal information, and we do not use your family's content to train artificial-intelligence systems.

04Text messages (SMS)

How you opt in. You consent to receive text messages from EverKeep at the mobile number you provide by checking the text-message consent box on a form on the Site, by giving us your mobile number and permission in person, by phone, or by email, or by texting us first. Consent to receive text messages is never a condition of purchasing anything from us. You may always choose email or a phone call instead.

What we send. Replies to your questions, discovery-call confirmations and reminders, scheduling updates during your project, and, if you opted in to them, occasional marketing messages about our services, events, and offers. Message frequency varies. Message and data rates may apply.

How to stop. Reply STOP to any message at any time and you will be unsubscribed from text messages. Reply HELP for help, or contact us at (717) 858-0049 or info@everkeepstories.com.

How we protect your mobile information. No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for the messaging providers that deliver the messages on our behalf, and only so that they can deliver them. All other categories of sharing described in Section 7 exclude mobile information and text-message consent.

05Email

If you request information, book a consultation, or subscribe to updates, we may email you about our services, events, and offers, and to follow up on your inquiry. Every marketing email includes an unsubscribe link. Unsubscribing from marketing does not stop the emails the Vault needs to send you, such as invitations and password resets, or emails about a project you have engaged us for.

06Cookies, analytics, and advertising

We use a small set of tools to understand how people find and use the Site and to reach people who have shown interest in EverKeep:

  • Website analytics, such as Squarespace Analytics and Google Analytics, which report visits and page views in aggregate.
  • Advertising and measurement tools, such as the Meta Pixel (Facebook and Instagram), the TikTok Pixel, and Google Ads tags. These let us show our advertisements to people who visited the Site and measure whether an advertisement led to an inquiry. They may share your browsing activity on the Site with those platforms, where it is combined with information the platform already holds about you under its own privacy policy.
  • Customer relationship management tools that help us keep track of your inquiry, our conversations, and which pages you visited after clicking a link in our email.

You can control these tools in several ways: block or delete cookies in your browser; use the ad settings of Facebook, Instagram, TikTok, and Google to limit ads based on your activity; install the Google Analytics opt-out browser add-on; or contact us and ask us to remove you from our advertising audiences. The Site will still work if you block cookies, though some features may not.

We do not respond to browser Do Not Track signals because there is no accepted standard for them.

07How information is shared

Within your Vault. Content you add to a Vault is visible to every member of that Vault: the Vault Owner, the Key Holders, and EverKeep Administrators who support and moderate it. Members of one Vault cannot see another Vault. Nothing in the Vault is public.

With the people who help us operate. We rely on a small number of service providers who process information on our behalf and only for the purposes described here:

  • website hosting and forms (Squarespace);
  • our customer relationship management, email, and text messaging platform, which stores your contact details, your consent records, and our conversation history and sends messages on our behalf;
  • scheduling tools for discovery calls;
  • application hosting, database, and media storage for the Vault;
  • secure video streaming for your films;
  • transactional email delivery for the Vault;
  • analytics and advertising platforms, as described in Section 6;
  • error monitoring and security services;
  • payment processing;
  • shipping carriers, who receive your name, address, and phone number to deliver physical items; and
  • professional advisors such as accountants and attorneys.

Each provider is bound by contract or by its published terms to protect your information and use it only to provide its service to us. Mobile numbers and text-message consent are shared only with the providers that deliver our messages, and never for marketing by anyone else.

When the law requires it. We may disclose information to comply with a subpoena, court order, or other legal process, or when we believe disclosure is necessary to protect someone's safety, prevent fraud, or defend our legal rights.

If our business changes hands. If EverKeep is acquired or merges with another company, your information may transfer to the new owner, who will be bound by this policy unless you are told otherwise.

We do not sell personal information and we do not share it with data brokers.

08Your film and your likeness

Your appearance, voice, and story in an EverKeep film are governed by the release and consent forms you sign during production and by your service agreement. Those documents control how the film may be used. This Privacy Policy covers the personal information around the film; it does not expand the permissions you granted in those forms.

09How long we keep information

  • Inquiries and marketing lists: until you unsubscribe or ask us to delete you, or after a period of no contact from you, and then deleted or anonymized. Text-message consent records are kept as long as we send you messages and for a reasonable period afterward so we can prove your consent.
  • Consultation records: as long as needed to serve you and for a reasonable period afterward.
  • Production materials (recordings, digitized photographs, and edit files): for the duration of your project and as described in your service agreement. Raw, unedited footage is retained only as your agreement provides.
  • Films and Vault content: for as long as the Vault is active. Our aim is to preserve your family's Vault for the long term. If a Vault is archived or closed, we keep its contents for 12 months to allow the family to reclaim them, then delete them.
  • Account information: for as long as your account exists, then deleted within 30 days of closure.
  • Backups: deleted content may persist in our encrypted backups for up to 90 days before it is overwritten.
  • Order and shipping records: as required by tax and accounting law and for as long as needed to handle replacements.
  • Financial records: as required by tax and accounting law.

10How we protect information

Trust is one of our core values, and we treat your family's memories accordingly. The Vault uses encrypted connections (HTTPS), hashed passwords, email verification, role-based access controls, rate limiting, and single-use, revocable invitation links. Films stream through protected links and are never available at a public address or as a downloadable file. Member media is stored privately. We keep regular encrypted backups and separate our development, testing, and production systems. Contact and consent records are kept in access-controlled accounts limited to the people who need them.

No system is perfectly secure. If we learn of a breach affecting your personal information, we will notify you as required by law.

11Your choices and rights

Marketing emails. Click the unsubscribe link in any marketing email, or contact us.

Text messages. Reply STOP to any message.

Advertising. Use the controls described in Section 6, or ask us to remove you from our advertising audiences.

Access and correction. You can view and update your Vault profile and notification preferences in your settings. For anything else, contact us.

Your content. You can edit or delete your own memory posts, comments, and calendar events at any time. Deleted items are recoverable for a short period and then removed.

Leaving a Vault. You may ask the Vault Owner or EverKeep to remove you from a Vault. Because a Vault is a shared family record, content you contributed stays in the Vault after you leave unless you delete it first or ask us to remove it.

Deleting your account or your information. Contact us to close your account or to ask that we delete the information we hold about you. We will do so as described in Section 9, except where we must keep it for legal or accounting reasons.

Rights under privacy laws. Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to limit certain uses, and to not be discriminated against for exercising those rights. To make a request, email info@everkeepstories.com. We will verify your identity before acting and respond within the time the law allows. If you disagree with our response, you may appeal by replying to our decision.

12Where your information is processed

EverKeep is located in the United States and our service providers store information on servers in the United States. If you use the EverKeep Experience from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

13Third-party links

The Site links to our social media pages on Facebook, Instagram, and TikTok, and may link to scheduling and payment services. Those platforms have their own privacy policies, and we are not responsible for their practices.

14Changes to this policy

We may update this policy as the EverKeep Experience grows. When we make meaningful changes, we will post the new policy here, update the date at the top, and, for Vault members, notify you by email or in the Vault before the changes take effect.
